Man Jailed in UK for Removing Condom Without Partner's Consent





A man from Brixton, South London, has been sentenced to more than four years in prison after secretly removing a condom during consensual sex. This act, known as "stealthing," is classified as rape under UK law. The conviction of Guy Mukendi, 39, sets a significant legal precedent and underscores the importance of consent in sexual activities.


The victim had consented to have sex with Mukendi on the condition that he used a condom. However, during the encounter, Mukendi removed the condom without her knowledge. This breach of conditional consent led the victim to contact the police in May 2023 after she realized what had happened. Forensic evidence and text messages were crucial in the investigation, with Mukendi admitting in messages that he had done it because he had not had sex in a long time.


The case was tried at Inner London Crown Court, where the jury was presented with compelling evidence, including the text messages between Mukendi and the victim. The court found Mukendi guilty of rape on April 2, 2024, and he was sentenced to four years and three months' imprisonment on the following Thursday. The victim was also granted a five-year restraining order against Mukendi.


Under the Sexual Offences Act 2003, consent is invalid if it is obtained through deception about the nature of the act. This concept, known as "conditional consent," played a pivotal role in Mukendi's conviction. Although the Act does not explicitly mention non-consensual condom removal, previous cases have established that stealthing falls under the definition of rape.


A spokesperson for the Metropolitan Police emphasized the importance of recognizing stealthing as a form of rape. "The victim did the right thing to call the police straight away, and her bravery should not be overshadowed," they said. The police force reiterated its dedication to securing justice for victims and raising awareness about the crime.


Victims of sexual abuse and violence, including non-consensual condom removal, are encouraged to report incidents to the police immediately. Prompt reporting can significantly enhance the chances of securing forensic evidence and achieving justice.
