Emirship Dispute in Kano State: A 3rd Conflicting Court Order

  


Kano State is currently embroiled in a significant emirship dispute, marked by a series of conflicting court orders and escalating tensions. The turmoil began with the dethronement of the 15th Emir of Kano, Aminu Ado Bayero, and the subsequent enthronement of Muhammadu Sanusi II as the 16th Emir. This development has reignited a historical power struggle, further complicated by recent judicial interventions.

Aminu Ado Bayero was dethroned last week in a dramatic turn of events that saw Muhammadu Sanusi II, previously dethroned in 2015 by the former governor Alhaji Abdullahi Ganduje, reinstated as the Emir of Kano. This reinstatement followed a Federal High Court ruling that prohibited security forces from arresting, detaining, or harassing Bayero. The court also ordered the removal of Sanusi from the Emir Palace in Kano.

In a surprising twist, a Kano State High Court issued an order instructing Aminu Ado Bayero to desist from assuming the role of emir and directed the police to evict him from his residence in Nassarawa. This ruling came on the heels of the Federal High Court's decision to protect Bayero's rights.


Adding to the complexity, another Federal High Court ruling has now ordered the eviction of the reinstated Emir Muhammadu Sanusi II from the Kofar Kudu Palace. Justice S. A. Amobeda, who presided over the case, issued an interim injunction to maintain justice and peace in Kano State. The order mandates the restoration of all rights and privileges to Aminu Bayero, recognizing him as the rightful Emir of Kano. This ruling restrains any attempts to infringe on Bayero’s rights and prevents unauthorized occupancy within the palace.


The conflicting court orders have intensified the emirship tussle, creating an atmosphere of uncertainty and unrest in Kano State. The State High Court had previously restrained security agencies from evicting Sanusi and interfering with his official duties, thus setting the stage for a legal battle over the rightful holder of the emirship.


Justice Amobeda’s decision to recognize Bayero and order Sanusi’s eviction underscores the legal complexity and political implications of the dispute. The Federal High Court's ruling emphasizes the importance of maintaining peace and order, while protecting the rights and privileges of Bayero as the 15th Fulani Emir of Kano.


The ongoing dispute is set to continue, with the Kano State High Court scheduling a hearing for the motion on notice for June 13, 2024. This hearing will likely be a pivotal moment in determining the future of the emirship in Kano State.
